Case Brief 1

Description

Preparing case briefs is a recognized way of learning legal principles.  Find the cases of Jacobson v. Massachusetts 197 US 11 (1905) and Lochner  v. New York 198 US 45 (1905).
SAMPLE:
CITATION: Marbury v. Madison 1 Cranch 137, 2 L.Ed. 60 (1803)  (Title of the case, X vs Y)
NATURE OF CASE: Form of action, type of proceeding, and relief sought.  (Explains nature of legal proceedings, explanation of decision rendered my appellate court)
FACTS: What led to the judicial action.  (1 or 2 sentences, what happened that led to the legal proceedings? X sued Y, breach of contract, etc.)
ISSUE: The concise question to be answered (Concise statement of the question the court was being asked to address, written to be answered yes or no) 
HOLDING: What did the court decide?  
RATIONALE: Why did the court rule as it did? Take directly as quotation from published opinion.
